>> it is tuesday, december 3rd and 5:00 in the east. >> a stunning revelation in the derailment of that new york city commuter train that left four passengers killed and dozens more injured. they say the metro north train was going 82 miles an hour! >> wow. >> into a sharp curve that had a 30 miles an hour speed limit. that, folks s a bad combination. but it is still too soon, they say, to determine who or what is to blame here. a lot of questions. cnn's renee marsh is following developments for us. >> reporter: john and zoraida, we know this morning how fast that commuter train was going but still don't know why. the report shows that the train was traveling at approximately 82 miles an hour as it went into a 30-mile-an-hour curve. that is too fast for an approach that had a speed limit of 70 and way too fast for the curve's 30 miles per hour limit. deepening the mystery, the ntsb

says in two minutes, the train insplikly went 82 before jumping the track. mechanical problem or human error is too early to tell. rockefeller, 20-year veteran of the record, why was the train going so fast? we know investigators say he tried to brake but the train didn't stop according to a law enforcement official. the ntsb, they will look at whether fatigue was a factor. >> we don't have the work history at the moment. we will be developing what we call a 72-hour time line so that we have a good understanding of what sort of activities preceded this accident. >> reporter: rockefeller appeared ko herein another official said, but drug and alcohol tests were conducted. the ntsb says there's no

indication at this particular time of sabotage, but they are reviewing surveillance video from a nearby bridge. upon word speed played a role in the crash, new york governor cuomo said any responsible parties will be held accountable. john, zoraida? >> thank you, renee. obama care website has had its first major test in relaunching on sunday and it got close to the 100,000 users it's supposed to handle on a daily basis. people in some states were met with a page that put them in line to get help a problem cleared up overnight. overall the site shows progress but has doubts it can enroll the number of it needs to by the end of march. president obama will refocus people on the benefits of obama care and the white house will emphasize one benefit of the law each day until december 23rd, that is the deadline to sign up for coverage in january. vice president joe biden is in japan this morning, the first

stop on a week-long asia trip that includes visits to china and south korea. the vice president had planned to focus on trade and economic issues but suddenly he is finding himself to calm rising tensions in the region over the east china sea claimed by china and japan. the dispute intensified last week with china's claim of an airplane defense identification zone over these islands. accusations this morning against syrian president bashar. the human rights chief says massive evidence collected over the course of the 33-month-old conflict in syria indicates asawed sad in war crimes and crimes against humanity. cnn's frederik pleitgen is following this for us and live in damascus. does this report name bashar al assad specifically? >> reporter: it doesn't name him

specifically but does implicate him. the report says that these war crimes and crimes against humanity go all the way to the top levels of the syrian government, including responsibility for the office of the head of state and that is bashar al assad and a strong statement the united nations is making. the deputy foreign minister came out and said they give no credibility to this report whatsoever. they said, quote, pela who is the u.n. human rights chief has talked to, quote, nonsense in the past and they are sort of trying to brush this off but it is something will carry a lot of weight internationally. the united states nations head of human rights wants to take syria to the international criminal court and that would be something that would up the ante considerably, zoraida.

morning, phil? >> reporter: good morning, john. yes, behind me, the independence square, a pretty big crowd of people here but the vast majority of protesters who were here walked ten minutes from here to the country's parliament building because opposition leaders today are trying to bring a vote of most confidence against the government. if that is successful that would force the resignation of the prime minister and his ministers. outside the parliament building we were a short time ago, crowds of thousands of people there cheering very, very loudly and very much calling for the government to resign or calling for this vote of no confidence to be successful. there is also a very strong security presence there as well. lines and lines of police officers in full protective gear. it is interesting to see just how that will develop over the course of the day because the most intense violence that we have seen has been outside government buildings just like

the tapes sealed says he will not appeal. very hard to hear. paul ciancia is is not expected to enter a plea. the hearing will address the charges and possible bail. prosecutors could seek the death penalty here. the alleged facebook killer is now charged with first-degree murder. police in miami say 31-year-old derrick vienna shot his wife and posted a picture of her dead body on facebook. detectives say he claimed self-defense when he shot 26-year-old jennifer alonzo in august but police evidence indicate that she was on her knees with one arm raised in front of her at the time of the shooting including a defensive posture. health scare for dozens of passengers aboard a us airways

flight. this was on saturday. the man had been cleared to fly by tsa agents in austin but midway through the flight the cdc notified the tsa that the passenger had do not board status because of tuberculosis. >> the flight attendant came down from the front of the aircraft and carrying a mask and approached a slender man in a window seat about halfway down. everybody was aware of this, watching this. she told the man to put the mask on. >> i did interview the individual directly. he is very cooperative and wants to know just as much as anyone else whether he has active tuberculosis. >> so arizona public health officials say since the flight was less than eight hours passengers were not at significant risk of exposure. >> i'm not sure that's a flight i would like to have been on. 39 years in prison possess fora hospital worker who caused

nearly three times too fast going into a curve. new information on what caused a deadly train derailment in new york. as family members of the victims share their stories. breaking overnight.

vice president biden in asia trying to stop. >> the chaos pushing the country into crisis and we are live in bong do bangkok with this developing story. >> about 30 minutes past the hour right now. still there are many unanswered questions in the deadly commuter train derailment in new york city. one thing the national transportation safety board now knows for sure speed was a factor in that crash. the train was going 82 miles an hour. as it turned into a curve with a speed limit there is 30 miles per hour. but investigators have yet to determine if human error or mechanical failure is to blame for this. cnn's jason carroll spoke with a member of the ntsb team. >> the curve was 30 and accelerated to 82 and when he should have been slowing down the train was speeding up?

>> that is correct. >> reporter: what does that tell you? anything at all? >> at this point in time, i can't really say. >> they are not sure exactly what caused the train to speed up. was it the operator or was it a malfunction? crews have now removed the train cars from the track as this investigation intensifies. authorities question the locomotive engineer william rockefeller, jr. who was among those injured. they are in possession of his phone and waiting on drug and alcohol tests as well. four passengers died in this accident. more than 60 others were injured. let's not forget the victims. they are 54-year-old donna smith. 59-year-old james ferrari and 35-year-old ann kis on ock and jim loafll, who is 58. cnn spoke exclusively with the lovell family. >> my dad was not a victim. i don't want him to be known as a victim. jim lovell was so much more than just a victim.

welcome back. 39 minutes past the hour. after days of violence and unrest in thailand, opposition protesters suddenly find no opposition from the thy government. both sides in this conflict have called a truce and it is expected to last several days. cnn's paula hancock is live in bangkok with all of the details. what can you tell us? >> reporter: that's right, a truce for the next couple of days at least. this is because both sides decided to step down from these protests and from the violence because of the king's birthday on thursday. now, the king here in thailand is much revered and very much loved by all thy people and neither side wanted to be seen making a political hate during that time. this isn't a political solution. this is just a temporary truce until the king's birthday has passed. now as you say, we have seen on sunday and monday some violence

very localized violence, but still violence on the streets of bangkok. protesters were trying to get into government tanks, which is the feat of political power in thailand. we saw some of the protesters with sling shots, with rocks and throwing water bottles and, in return, tear gas and water cannons and water bullets were seen. a festival atmosphere, though, today. and spots where vicious clashes were going on, with we saw the protesters and the comris coming together once the barricades were lifted hugging and shaking hands and showing no animosity between them so certainly a different atmosphere on the streets of bangkok than it was the past couple of days. >> how bizarre, that change like that. you wish it would last. paula hancocks, thank you.
